I've seen multiple media reports state that his cap hit would still count if he was suspended. Wouldn't be the first time the media was collectively wrong about the CBA though.
Also, you wrote that the Bruins could send him to the minors once his NMC expires to get cap relief, but wouldn't his cap hit still count because of the 35+ thing?

Isn't that how Lamoriello got out of Mogilny's 35+ cap hit? I'm not absolutely sure anymore as it's been some time since I looked into it.

I thought Mogilny was LTIR.

Maybe the following season, because the 35+ rule really kicks in beyond year one, he went on LTIR and they beat the second year of his 35+ deal that way.
So maybe waiving Thomas doesn't do them any good as Carlton pointed out.
