Please explain Datsyuk deal

Could someone please explain this to me.

When Luongo was in the process of being shopped around, it was mentioned (many times) that if he retired before the end of his contract, Vancouver would be on the hook for the cap hit.

They are now talking about the same thing as it applies to Shea Weber - if he retires before his contract is over, the Preds are on the hook cap-wise.

So how is it that Detroit was able to trade away their cap obligation on Datsyuk's contract? Would the other teams be able to trade the "cap hit" once it was triggered?

Datsyuk didn't retire - at least, not officially. His official status is suspended by the team for leaving for Russia.

I thought he had signed retirement papers. If not, that's the loophole.

Nope. No papers. It's a loophole, but it's not one that's going to be used enough to close. Teams aren't going to be super happy about having to carry cap hits for de facto retired players.

It's a lot less worse than the joke of Chris Pronger's contract.

Yeah funny that Pronger hasn't "officially" retired but he still somehow qualified for the HHoF.

Why was Kovalchuk allowed to terminate his contract, but not Datsyuk?  Is it a 35+ contract thing?

Pretty much, yeah. The Wings were on the hook even if he officially retired. By not doing so, they had this option.

Funnier still is the fact that despite his status as a player under contract, albeit not playing, he was able to hold down a job in the NHL league office that allowed him to make decisions affecting other players and teams.
